CreateShorts.today provides AI-powered video editing services to create short-form content from longer videos. The Service is provided “as is” without warranties. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice where legally required.

3. User Content and Intellectual Property
Content Ownership: You retain all rights, title, and ownership of content you upload. We claim no ownership over your content. You may request deletion of your content at any time.
User Warranties: You represent and warrant that:
- You own or have lawful rights to use all uploaded content
- Your content does not infringe third-party intellectual property rights
- You have obtained necessary consents for any personal data in your content
- Your content complies with applicable laws in your jurisdiction
Processing License: You grant us a limited, non-exclusive, revocable license to process your content solely to provide our Service. We do not use your content for training AI models or any other purpose without explicit consent.

4. Privacy and Data Protection

6. Liability and Risk Allocation
Service Disclaimer: The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.
Limitation of Liability (US Users): To the maximum extent permitted by law, our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. We exclude liability for indirect, incidental, or consequential damages.
EU User Rights: Nothing in these terms excludes or limits our liability for death, personal injury, fraud, or other liability that cannot be excluded under EU law. For consumers in the EU, statutory rights under applicable consumer protection laws are not affected.
User Indemnification: You agree to indemnify us against claims arising from your use of the Service, violation of these terms, or infringement of third-party rights, except where prohibited by law.
7. Billing, Payments, and Refunds
Payment Terms: Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as specifically stated below or required by law.
Refund Policy: We offer refunds in the following circumstances:
- Technical issues preventing service use for more than 48 hours (prorated refund)
- Billing errors or unauthorized charges (full refund)
- Cancellation within 7 days of initial subscription (full refund for first payment)
EU Consumer Rights: EU consumers have the right to cancel within 14 days of purchase and receive a full refund, except for services that have been fully performed with your prior consent.
Refund Process: To request a refund, contact nikita.proleev.original@gmail.com with your account details and reason. Approved refunds are processed within 5-10 business days to the original payment method.
Subscription Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you retain access until then.
8. Account Termination and Suspension
Termination Rights: We may suspend or terminate accounts for violations of these terms, with notice where required by law. You may terminate your account at any time.
Data Upon Termination: Upon termination, we will delete your personal data within 30 days unless retention is required by law. You may request data export before termination.
Notice Period: For EU users, we provide reasonable notice before termination unless immediate termination is necessary for legal compliance or security.
9. Dispute Resolution
Governing Law: These terms are governed by the laws of Georgia, and the laws of the Republic of Ireland for EU users, without regard to conflict of law principles.
Jurisdiction: Users agree to the jurisdiction of Georgian courts. EU users may bring proceedings in their country of residence or Ireland.
Alternative Dispute Resolution: EU consumers may access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr/
Class Action Waiver: Users waive the right to participate in class action lawsuits, except where prohibited by applicable law.
